近年の犯罪傾向を見ると、行為者の精神の障害又は未確立に起因する事件の数が急増している。このような状況下、従来の刑法上の責任能力概念及びそれを判定するための精神鑑定のあるべき姿についても変革が求められる。刑法は第39条において心神喪失・心神耗弱という形で責任能力について規定すると共に、第41条において14歳未満の少年の責任無能力を規定する。また少年法は、20歳未満の少年について原則として刑事処罰の対象としない旨規定する。しかし、近時、凶悪犯罪の多発を受け、責任能力や処罰対象を広く認めようとする傾向が出てきている。これは、行為に対する非難可能性に刑罰の根拠を求める責任概念の趣旨に反するもので、被疑者・被告人の人権と社会秩序維持の調和の観点からも好ましくない。しかし、従来の責任概念のあり方にも問題無しとはしない。これをより精緻化し、国民の理解を得られるものとするために、その判断の根拠を可及的に客観的にする必要がある。そのためには、精神鑑定の基準を客観化するとともに、第三者機関を設立することによって恣意的な鑑定がなされることを排除する仕組の確立が必要である。最後に、責任能力概念及び精神鑑定は、社会の安定及び個々人の人権を守るための手段に過ぎないとの理解から、真に安定した社会の実現に向けた抜本的解決を模索する。家庭、教育現場、地域共同体が緊密に協力し、犯罪予防の実効性の高い社会を小さな単位から構築し、それを情報技術などを利用して社会全体のシステムに昇華させていくことが真に秩序ある社会の構築のための最善の方法であると考える。 : Recently, the number of crimes carried out by offenders whose minds are affected or not ripe are increasing dramatically. In such a situation, the traditional concept of criminal responsibility and the method of psychiatric test should be reformed. Under the Criminal Law, it is prescribed in Article 39 that the one who is insane would be irresponsible for his/her actions. It is also prescribed in Article 41 that the one whose age is under 14 would be irresponsible. And under the Juvenile Act, it is pre-scribed that the one whose age is under 20 would not be punished in principle. However, the trend to extend the object of punishment or the subject of criminal responsibility is notable nowadays, because of the frequency of heinous crimes. Such a trend is against the spirit of the concept of criminal responsibility, which is based on the theory that the punishment would only be allowed when the action is blameworth, and can never be accepted from the point of the balance between the human right of accused and the public order. But the above mentioned point does not mean that there isn't any problem in the traditional concept of criminal responsibility. We must make it much more sophisticated so that it would be accepted by the nation. The basis of the judgement should be objective as much as possible. For this purpose, the criteria of psychiatric test should be objective, and we should establish a fair and neutral institution to carry out this test. Finally, I would like to conclude that the best solution is to set up a social system to prevent any crime, the system which every family, school, and community takes part in, the system by which we can share information via computer network. I understand that the concept of criminal responsibility and the method of psychiatric test are just the means to protect human rights as well as public order. To realize a true public peace, we must seek the radical solution.
