株式会社不二家が消費期限切れの牛乳を使用してシュークリームを製造し、埼玉県により食品衛生法に基づき定められた埼玉県食品衛生法施行条例に規定する管理運営の基準に違反するとされた。この件に関して、食品衛生とコンプライアンスの観点から、食の安全・安心に関して論じた。不二家の自主検査によると、期限切れの牛乳に問題はなく、また、この牛乳を原料として製造したシュークリームも問題のないものであった。但し、この自主検査結果は原料としての使用時点では得られていない。牛乳の原料としての使用の可否は官能検査で判断できる部分もあり、使用時点では官能的に問題のない原料であったため、シュークリームの製造がなされたと推察される。結局、期限切れの牛乳は製造後に原料として使用可能と科学的に判断されたこととなる。食品衛生法およびJAS法は直接消費される食品の飲食に起因する衛生上の危害の発生防止を目的としているため、食品の原材料は両法の適用範囲外である可能性が高く、埼玉県は消費期限切れの牛乳を原料として使用したこと自体が違反ではなく、施設および食品等の取り扱い等に係る衛生上の管理運営違反とし、厳重注意どまりとした。結果的に問題のない原料であったにせよ、社会規範に照らして安全・安心な食品を製造するにしては、衛生管理や品質管理が経験と勘に依存した製造と言わざるを得ない。経験と勘を科学的・合理的な根拠に昇華させ明確な基準を設定した後に使用すべきであった。不二家の問題も含めた食品に関わる報道により、食の安全・安心を支える食品表示の信頼性が低下しているが、食の安全・安心のために食品に関する正しい情報を今後とも公開していく必要がある。 : FUJIYA CO., LTD has made the cream puff from the milk which use-by date has been invalid. Saitama prefecture judged that this manufacturing violated against the Food Sanitation Law Enforcement Ordinance of Saitama Prefecture. Depends on self-imposed examine of Fujiya, this milk was normal quality and so was this manufactured cream puff. However, these results were not clear before they actually used this milk. The sensory examine is an important index to give a decision for the quality of the raw material. It seems that the cream puff was enough to be manufactured and sold because there was no problem in the sensuality by the workers when they use this milk. Though this products had normal quality as the result, I could not help saying this manufacturing process was rough from the viewpoint of the compliance. The reliability of the safety and the reassurance of foods have decreased for the report of the problems related to foods including the Fujiya by the mass media. In order to guarantee the safety and the reassurance of foods, we need to reveal the real information on foods and open them to the public in the future.
